Parent/Guardian Agreement & Liability Release

PARENT OR GUARDIAN AGREEMENT & LIABILITY RELEASE

By registering my minor child(ren), for which I am the parent or legal guardian, with the Mills Farm Mustang Swim Team (“Mustangs”), I represent that these are my minor children or are minor children for which I am the legal guardian and I agree, consent, release and/or waive as to the following:

Assumption of Risk:

I agree and acknowledge that swimming, swimming pools, and surrounding areas of swimming pools and swim practices, meets and events themselves carry an inherent risk of injury and death, and that the same also carry risk of property theft, damage and loss. I recognize and acknowledge that the Mustangs hold practices, meets and events at the Mills Farm Homeowner Area Homes Association (“HOA”) amenity area, which contains additional unmonitored pools and certain amenities, including two pools (the “infinity pool” and “kiddie pool”), which are solely maintained for use by the HOA during Mustang practices and not used or monitored by the Mustangs before, during or after swim team practices.

Further, I recognize that the Mustangs host meets which invite various guest swim teams (“Guest Teams”) in the Southland Swim Association league (“SSA”)and also direct Mustang swimmers to swim at Guest Team pools at away meets; I agree and acknowledge that the Mustangs have no authority or control over the pools, facilities, or surrounding areas of the Guest Teams pools. I agree and understand that I am assuming these risks on behalf of myself and minor children, or minors for which I am the legal guardian.

Release of Liability & Indemnification:

  • Mustangs & HOA: I agree to release and hold harmless:(a) the Mustangs, its team participants, directors, managers, employees, contractors, coaches, and volunteers; and (b) the HOA and its Board of Directors. I agree to waive any claim or cause of action for ordinary negligence, related thereto, or otherwise allowed by law, for which I or my minor children, or minor children for which I am the legal guardian, may have in the future, by reason of any injury, property damage or other losses I may sustain out of participation with the Mustangs, whether at the HOA swimming pools or Guest Team pools (including travel and transit to and from practices, meets and events whether by vehicle, foot, bike, scooter, e-bike, or other mode of transportation), and, as allowed by law, agree to make no claim of any kind or character and hereby waive, discharge and release any and all claims, which might arise hereafter against the Mustangs and its team participants, directors, managers, employees, contractors, coaches, and volunteers. I further agree to indemnify the Mustangs and HOA for any and all injuries, death, property damages or losses caused by or resulting from my minor child, children for which I am the guardian, myself, family members, or my invited guests’ conduct or actions.
  • SSA: I further agree and consent to the Southland Swim Association Waiver & Release of Liability:

SSA Release of Liability

In consideration of and as inducement for being accepted into the Southland Swim Association and/or being permitted to participate in its practices or events, I, the undersigned, hereby take the following action for myself, my executors, administrators, heirs, next of kin, successors and assigns: 

a) I agree to hold harmless and make no claim of any kind or character and hereby waive, discharge and release any and all claims, if any, which might arise hereafter against the Southland Swim Association and its affiliated teams, members, officers, coaches, agents, contractors, and employees;

b) I agree not to sue any of the persons or entities listed in part (a) for any of the claims or liabilities that I have waived, released or discharged herein;

c) I agree to indemnify and hold harmless the Southland Swim Association and participating homes associations and/or private clubs providing pools or other facilities from all claims; and

d) I understand that most teams in the Southland Swim Association have security cameras at their pools. Families should expect that, barring any technical issues or unforeseen circumstances, these cameras will be recording during swim meets.

PHOTOGRAPHY & VIDEO:

  • The Mustangs comply and adhere to all photography and video camera policies governing the USA Swimming and Southland Swim Association.
  • From time to time, photographs, videos and/or audio clips may be taken of youth engaged in Mustangs’ activities. I agree to the photographs, videos, and/or audio clips to be taken of my minor child(ren), or minor children for which I am the legal guardian, and further give the Mustangs permission to use all photos, videos, and/or audio clips taken for limited use in the end of season video and team website/newsletters, and for gifts of appreciation to coaches, volunteers and/or corporate sponsors.
  • I further recognize that the Mustangs host Guest Teams for home meets and direct and invite Mustang swimmers to attend Guest Team away meets. Guest Teams and the SSA also may take photographs, videos and/or audio clips of my minor child(ren), or minor children for which I am the legal guardian, and I agree to the Guest Teams and SSA’s photography, use and publication of these photos, videos, and/or audio clips for similar purposes or otherwise the promotional use by the league or Guest Teams.
  • I agree to and understand that the HOA has installed video cameras in and around the pool area. However, while video images may be captured of my minor child(ren), or minor children for which I am the legal guardian, the HOA is restricted from monitoring, accessing, reviewing, or obtaining those images during the period of time when the Mustangs’ use the pool(s) facilities and surrounding areas, unless as otherwise compelled by subpoena or court order. I also agree and understand that the Mustangs may obtain and review footage recorded during this time if necessary to respond or defend the Mustangs or Mustang swimmers.

MEMBERSHIP:

  • I understand and accept that the Mustang Board of Directors retains the sole discretion to refuse a place anyone on the team as otherwise allowed by law, and that placement on the swim team can be restricted, suspended, or rescinded at any point in the season with or without a reason provided and without a refund of my registration dues paid.
  • I understand that no one is guaranteed a spot on the team, and that registration priority will be given consistent to the Mustang policy.

CONTACT INFORMATION:

  • I agree to have my name, address and registered phone number listed in the Mustangs’ directory to be published electronically for current team members on the team website.

CODE OF CONDUCT:

I further agree and acknowledge the SSA Code of Conduct (below) and further agree to adhere to such Code. I recognize that not adhering to the Code is grounds for disciplinary action, suspension or removal from the Mustangs

SSA Code of Conduct

The purpose of the Southland Swim Association (SSA) Swim League Code of Conduct is to establish standards of conduct that competitors, officials, and parents are expected to uphold while participating in SSA League swim meets and/or Mills Farm Swim Team swim practices/events. It is the goal of the SSA that these standards of conduct be incorporated into the daily management of SSA teams. Any individual with a complaint should be directed to a SSA League Representative or designee. 

1. All participating SSA teams will abide by the SSA Code of Conduct. 

2. The SSA has ZERO TOLERANCE for disrespectful, discriminatory, disruptive, bullying, indiscreet, and/or destructive behavior language and music at a swim meet, swim practice, or swim social event. It is the responsibility of a team manager, coach, competitor, or parent, to make every effort to not engage in such activities and to avoid guilt by association with such activities. 

3. No team manager, coach, competitor, family member, guests or parent, shall act in an unsportsmanlike manner during an SSA event. This includes but is not limited to the following 

  • Making insulting or derogatory remarks, gestures, or acts, including taunting. 
  • Trying to influence or showing disgust with the officials’ decisions. 
  • Using obscene language. 
  • Illegal activity, for example vandalism or theft.
  • Coaching, swimming or volunteering under the influence of alcohol or illegal drugs during a swim meet or swim practice. 

4. SSA teams must maintain orderly conduct at all times including after-meet celebrations. 

5. The reporting of a violation to the SSA Code of Conduct will be to a SSA League Representative or designee. 

6. The SSA Board of Directors will be consulted when a team, competitor, parent, coach, team manager, has been involved in an offense. This may result in barring the offender(s) from further participation in SSA league activities. 

VIOLATION OF THE SSA CODE OF CONDUCT

At the discretion of a meet referee/starter and/or SSA League Representative(s) or designee(s), any violation of this Code of Conduct may result in one or all of the following penalties: 

  • A warning may be issued to the offending party. However, a warning is not required for disciplinary action. The individual(s) involved may be asked to leave the premises;
  • A meet or practice may be suspended until the offender(s) complies with the instructions of the SSA League Representative(s) or designee(s);
  • An offending party may lose future meet participation opportunities; An offending party may be barred from future involvement with the SSA.
  • We, hereby agree to abide by the rules of conduct, as set forth above, and acknowledge that should we violate any provision of the SSA Code of Conduct, we may be subject to disciplinary action.

    ​Mills Farm Swim Team Volunteer Agreement

    Being a part of a successful Mustangs swim team season requires a commitment from not only swimmers, but parents as well. We will host three (3) home meets (requiring 55 Mills Farm volunteers at each meet) and attending two (2) away meets, (requiring 35 Mills Farm volunteers at each meet).

    All families are required to work volunteer shifts at our meets. Some positions require volunteers to be 18 years of age or older (age requirements will be noted on the signup). Hours worked can count as community service.

    A volunteer opt-out of $600, due by May 1, is available for those families who prefer not to work any volunteer shifts. A sponsorship donation is separate from the volunteer opt-out.

    During the season, if you do not complete all of the required credits, you will be fined $100 per credit not completed. Failure to pay these fines will mean: 1) your child will not swim in the Championship meet and 2) your child will not be able to register for the swim team in subsequent years.

    VERY IMPORTANT: If you are unable to cover a volunteer shift for which you have signed up, you are responsible for finding a volunteer replacement. It is not the responsibility of our volunteer coordinators. If you do not show and do not send a replacement, you will be fined $100 per credit.

    I agree to make the 2026 Mustangs swim season successful by serving as a volunteer. I understand that each family is expected to volunteer for a number of meets (typically 3-4) throughout the season. Exact requirements will be communicated as soon as overall enrollment numbers are confirmed. I also understand I must sign up for my volunteer shifts online and that sign-ups are released on Sundays at 8pm. I understand I may opt-out of the volunteer requirements by paying the $600 volunteer opt-out by May 1, 2026.
